1. Who we are & what these terms cover
These "Terms & Conditions" (these "Terms") govern your access to and use of Captain Diginaut products and services, including websites, portals, learning games, leaderboards, social recognition features, and mobile/web applications (collectively, the "Services"). The Services are operated by Captain Diginaut ("we", "us", or "our").
By using the Services, you agree to be bound by these Terms and our Privacy Policy (collectively, the "Agreement").
If you do not agree, do not use the Services.
2. Eligibility & accounts
2.1. Minimum age
You must be at least 8 years old to use the Services. For ages 8-13, parental/guardian consent is expected for account registration and maintenance. If you are under the age of majority, you represent that you have obtained parental/guardian consent.
2.2. Institutional / employer accounts
If you are signing up on behalf of a school, university, company, or organization, you confirm that you have permission to act for that organization, and the organization agrees to follow these Terms. In this case, "you" refers to both the individual and the organization.
2.3. Accurate information
You agree to provide accurate, current, and complete information during registration. We reserve the right to request additional details to verify profile authenticity (e.g., personal information, supporting documents). Failure to cooperate or provide requested information may lead to account suspension or termination.
2.4. Security
You are responsible for safeguarding your login credentials and all account activities. You must notify us immediately at for.ehte@gmail.com in case of unauthorized access or suspected breach.
3. Description of the Services
We provide gamified digital literacy learning experiences, quizzes, online classes, Gen AI based solutions, and (optionally) public recognition features that may display usernames, scores, and achievements only if you opt in. Some features may be beta, experimental, or subject to change.
4. Acceptable use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
- Harass, threaten, defame, impersonate, or abuse others.
- Upload, post, or transmit content that is harmful, infringing, defamatory, obscene, hateful, or otherwise objectionable.
- Attempt to probe, scan, or test the vulnerability of the Services, or circumvent any security or authentication measures.
- Introduce viruses, malware, or other harmful code.
- Use automated means (bots, crawlers, scrapers) to access the Services without our prior written permission.
- Infringe or misappropriate any intellectual property or proprietary rights.
We may investigate and take appropriate legal action for any violation, including suspension or termination (Section 14).
5. User content & license you grant us
1. Your content. You may submit text, images, answers, feedback, scores, usernames, and other materials ("User Content"). You retain ownership of your User Content.
2. License to us (operational). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, host, store, modify, adapt, publish, display, perform, and distribute your User Content solely as necessary to operate, provide, improve, and promote the Services.
3. Public leaderboards & platform related recognition (opt-in). If you opt in to public recognition features, you authorize us to display your name/username, and our website related publicly. You can change this preference by emailing for.ehte@gmail.com.
6. Feedback
By submitting ideas, suggestions, or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or compensation.
7. Our intellectual property
All content and materials (text, graphics, logos, badges, storyline elements like "Captain Diginaut, LuCypher, Craftoria, Qila, Bodhika, MayaLok, Disha", icons, images, software, and audio/visual content) are owned by us or our licensors and protected by intellectual property laws.
We grant you a limited, revocable, non-transferable, non-sublicensable license for personal, non-commercial (or, where applicable, authorized organizational) use, strictly in accordance with these Terms.
You may not copy, distribute, modify, create derivative works, publicly display, publicly perform, or otherwise exploit any part of the Services except as expressly permitted.
8. Privacy & data protection
Your use of the Services is governed by our Privacy Policy. Please review it carefully.
9. Payment, subscriptions & refunds (if applicable)
If any part of the Services is paid:
- Pricing & taxes: Fees, billing cycles, taxes, and payment methods will be presented at checkout or via communication. Some features might be free during promotional periods. Changes will be notified in advance.
- Auto-renewal: Subscriptions will auto-renew unless canceled before the renewal date.
- Refunds: Refunds are governed by the Refund Policy (Section 17). There are no refunds for services or products bought unless explicitly stated.
- Failure to pay: Access to paid features may be suspended or terminated for non-payment.
10. Third-party services & links
The Services may contain links or integrations with third-party platforms, tools, or content (e.g., payment gateways, analytics, AI/LLM services). We are not responsible for third-party services. Your use of them is subject to their respective terms and policies.
11. Beta features & changes to services
We may offer beta or experimental features which may be changed, suspended, or discontinued at any time, without liability. We may also modify, suspend, or discontinue any part of the Services with reasonable notice where practical.
Not at this point, but our services in future could rely on third-party AI/LLM providers. Any beta features will be accordingly communicated to the users who are opting in for it. Any changes in policy or terms of use due to such new features or AI usage will be updated appropriately.
12. Disclaimer of warranties
The Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, secure, or that data will not be lost.
13. Limitation of liability
To the maximum extent permitted by law, we (and our directors, employees, agents, suppliers, and partners) will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages.
To the extent any liability cannot be excluded under applicable law, our total aggregate liability for all claims arising out of or relating to the Services or these Terms shall not exceed the amount you paid to us in the 6 months preceding the event giving rise to liability.
Some jurisdictions do not allow certain disclaimers or limitations; in such cases, these disclaimers/limitations apply to the fullest extent permitted by applicable law.
14. Indemnification
You agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with (a) your access to or use of the Services, (b) your violation of these Terms, or (c) your infringement or misappropriation of any third-party rights.
15. Suspension & termination
We may suspend or terminate your account or access to the Services, with or without notice, if:
- You violate any of our Terms, policies or applicable law;
- Your conduct risks harm to other users, the Services, or our reputation;
- We are required to do so by law or a governmental authority.
Upon termination, your right to use the Services ceases immediately. Sections intended to survive termination will continue (e.g., IP, disclaimers, limitations of liability, indemnities).
16. Governing law & dispute resolution
These Terms are governed by the laws of India, without regard to its conflict-of-law principles.
Venue: You agree that any disputes arising out of or relating to these Terms or the Services will be brought exclusively in the courts of India.
(Optional) Arbitration & class action waiver: Any dispute shall be resolved by binding arbitration administered by [arbitration body] in [city], and you waive the right to participate in a class action or class-wide arbitration. (Include only if you want arbitration)
17. Payment Processors
All financial transactions made in connection with the Service will be processed by a third party in accordance with their respective terms of use, privacy policy, and/or any applicable payment terms and conditions. We will not be liable for their services and we advise you to go through their T&Cs if needed.
18. Refund Policy
All payments are nonrefundable until already stated as part of the service and there are no refunds or credits for virtual Items or partially used membership periods, unless otherwise required by the law in your jurisdiction. If you cancel your periodic subscription to a paid Captain Diginaut service, you will continue to have access to the service through the end of your current billing period (no refund on pro-rata basis).
19. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide notice (e.g., by email, in-product notice, or updating the "Effective date" above) for already existing users. Your continued use of the Services after the revised Terms become effective constitutes your acceptance.
20. Force majeure
We will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, labor conditions, internet outages, or governmental actions.
21. Severability & entire agreement
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy and any applicable service-specific terms, constitute the entire agreement between you and us regarding the Services.
22. Use by School, Institution, and Organization Accounts
Captain Diginaut allows schools, colleges, companies, and other organizations ("Institutions") to register and enroll multiple users under a single account or program (e.g., through DigiVerse Leagues, inter-school/corporate challenges, or digital literacy initiatives). We may reach out to schools, colleges, and corporate organizations to inform them of our services and encourage their students or employees to participate.
Institutions are not required to enter into any formal agreement, provide payment, or undertake administrative responsibilities to enable access to our services. On the other side, if they want to do so, we could engage on a case to case basis. Should institutions wish to engage more formally in the future (e.g., bulk access, special workshops, or institutional programs), such arrangements can be governed by separate agreements, independent of these Terms of Use.
Institutions that want their engagement with us limited to the role of helping promote awareness of Captain Diginaut, their role will be advisory in nature only. In such scenarios, the participation (Students, employees or other individuals) is voluntary and their joining will be considered in their personal capacity. Captain Diginaut does not collect personal data from institutions without prior consent.
Until and unless driven by specific separate agreements (where institutions actively partner with us), institutions do not assume responsibility for the quality, outcomes, or administration of the services.
